trustee vesting orders.
5.
Subsection (3). The Treaty of Peace Order does not
seem to contemplate the use of vesting orders for shares, and
it may be a question whether the company may buy and re-issue
shares sold by the Custodian under Article 1(vii)(c) of the
Order.
6.
7.
Subsection (4) presents several difficulties:-
(a) Does it protect sales of shares under
Article 1(xvii)(c)?
(b) It affords no protection to the company,
e.g. against a shareholder who was erroneous
-ly believed to be a German national.
(c) It supplies conclusive evidence that the
requirements of the section have been com-
plied with. What does "requirements"
include? Does the transfer conclude the
question of nationality? In its application
to Article 1(xvii)(d) of the Order does the
sub-section make the transfer conclusive
evidence that the property was subject to
the charge? Has the sub-section any appli-
cation to sales of shares under Article
1(xvii)(c) of the Order?
Does subsection (5) enable the Custodian to charge
the fee provided for in Section 13 of Ordinance No.8 of 1916
(and in 5 & 6 Geo.5, c.105, s.13)?
29th June, 1920.
